General Terms of Service

These general terms (the "Terms") govern access to and the contracting of the plans and services offered by Evenely ("Evenely", "we") through the website evenely.com (the "Site"). By subscribing to a plan, requesting a custom project, or otherwise using the Site, you agree to be bound by these Terms.
1. Provider identification
Evenely provides its services under the trade name "Evenely". The full identification details of the Site's owner (legal name, tax ID and registered address) are available in the Legal Notice and are provided to the user before any contract is formalized. For any query, write to info@evenely.com.
2. Purpose and scope
Evenely offers a platform of gamified interactive dynamics for events, training, corporate communication and recruitment, available in two modes: (a) a subscription plan (Free, Basic or Premium) that lets the user build their own dynamics through a visual editor; and (b) custom development, through which Evenely designs, gamifies and builds the dynamic according to a fixed quote previously accepted by the client.
3. Subscription plans
The features, usage limits (storage, number of active dynamics, participants and screens) and price of each plan are detailed on the Pricing page at the time of contracting. Paid subscriptions renew automatically on a monthly basis unless cancelled by the user, which can be done at any time with no minimum commitment or penalty, taking effect at the end of the already-billed period.
4. Custom projects
Custom projects are governed by a specific quote, expressly accepted by the client before work begins, detailing scope, timelines, delivery milestones and payment terms. Any substantial change to the scope once the project has started may result in an adjustment to the quote, which will be communicated to and accepted by the client before being applied.
5. Pricing and payment
Prices shown on the Site do not include applicable taxes, which will be itemized during the checkout process. Subscription payments are made through the payment methods enabled on the platform. Non-payment of a fee may result in the temporary suspension of access to the contracted plan until it is resolved.
6. Right of withdrawal
In accordance with consumer protection regulations, you have a period of 14 calendar days from the date of contracting to withdraw from the contract without justification, unless you have started using the contracted service with your express consent, in which case you may lose this right under applicable law. 7. Intellectual and industrial property
All content on the Site (text, designs, code, the "Evenely" brand and logo) belongs to Evenely or to third parties who have authorized its use, and is protected by intellectual and industrial property law. Content the user adds to their own dynamics (text, images, branding) remains the user's property; the user warrants they hold the necessary rights over such content and holds Evenely harmless against any third-party claim arising from its use.
8. User obligations
The user agrees to make lawful use of the Site and of the dynamics created, not to introduce unlawful or offensive content or content that infringes third-party rights, and to provide accurate information during registration and contracting.
9. Limitation of liability
Evenely will take reasonable measures to ensure the availability and proper functioning of the Site, without this constituting a guarantee of uninterrupted availability. Evenely is not liable for decisions the user makes based on data or results generated by the dynamics, nor for damages arising from misuse of the service by the user or third parties.
10. Changes to these Terms
Evenely may amend these Terms to adapt them to regulatory changes or changes to the service itself. Amendments will be published on this same page indicating the date of the last update and, when substantial, will be notified to users with active subscriptions with reasonable advance notice.
11. Governing law and jurisdiction
These Terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts that correspond under applicable consumer protection regulations, without prejudice to any jurisdiction that may apply by law.
